 The Troy Davis Case: A Panel Discussion

Dean John Farmer, Rutgers School of Law - Discussing the procedural hurdles of the Antiterrorism and Effective Death Penalty Act and the possible legal implications of the Troy Davis case. 

Lawrence Hayes - Former New York death row inmate and member of the Campaign to End the Death Penalty (“CEDP”), discussing his personal experiences and the CEDP’s advocacy for Troy Davis. Amnesty International - Speaker from Amnesty International TBA.

Who is Troy Davis? Troy Davis has been sitting on Georgia’s death row for over 18 years for the murder of a police officer in Savannah, Georgia. He was convicted purely on witness testimony, with no physical evidence. The weapon used in the crime was never found. Since his conviction, 7 of the 9 witnesses have recanted or contradicted their testimony. Shockingly, the courts have denied him the right to present this new evidence because of the Antiterrorism and Effective Death Penalty Act, a federal law which limits death penalty appeals. Troy has come within hours of execution three times, only to be saved at the last moment.

On August 17, 2009 the United States Supreme Court ordered an evidentiary hearing at the federal district court level to review evidence of Davis’ innocence. In a scathing dissent, Justice Scalia noted that, "[t]his Court has never held that the Constitution forbids the execution of a convicted defendant who has had a full and fair trial but is later able to convince a habeas court that he is 'actually' innocent."
